Mayor: RE: David Fred "ATSER" Martinez

This publication is dedicated to & maintained by those of us who really care about this city. We are many --- (and growing stronger with more people joining our ranks everyday). We are the nameless , faceless city, county, state, federal, and corporate taxpaying citizens & workers who are sick of the "good ole boy system" here in Houston, Texas --We were born on 7-30-1999. We are --- married & single-male & female, maintenance worker to Deputy Directors. We are the faceless civil servants who year after year do our job. We are the one's who see the hard earned tax $$s of the citizens in this area used & abused and given away to enrich a few greedy people with each new administration. Our hobbies include: Watching our backs---as we try to bring you the truth of what is happening in Houston, and getting the REAL information out to the public.

Mayor, we have reason to believe you're being pushed by your Hispanic Senior Advisor, Carol Alvarado, to name Fred Martinez, of ATSER, as the owner's Rep. for the new arena deal, We also have reason to believe that because of her pushing, at least 3 board members, (Al Luna, Celina Garza, and Howard Middleton) have already sworn their allegiance to his nomination. We have been given reason to believe that this same influence has caused Mr. John Sedlak to add Fred's name to the "short" list for managing the construction for the new Metro Headquarters.

Mayor......let us REALLY inform you about DAVID FRED MARTINEZ. We believe you should have ALL the facts, before you put the word out that YOU think ... Fred's "the man".

Did you know his "former" partners are bringing a "class action" law suit against him for NOT paying them for the monies they invested in "ATSER"? But that's personal & you would say has nothing to do with his ability to manage a job.

We know he hand delivered a note to you thru Carol Alvarado, putting down another local Professional Engineer. YOU, will say that too is personal...NO Mayor, it's against the code of ETHICS of Professional Engineers, for one to denigrate another without providing a notice to them & a copy of the letter.

We hear more than ONE contractor is still seeking ANY kind of payment on that new building Fred erected for ATSER, after we raised such a fuss about you giving him free rent at 611 Walker for almost 2 years.

So far we have described a man who doesn't keep his word to his partners, isn't making timely payments on his bills and who has broken his own profession's code of ETHICS...not someone we'd be willing to recommend for ANY position ... but then YOU always have a reason to back losers & liars .... what did you say about DeLibero? .. You didn't recommend hiring her based on her resume ... but on her results?

Here's some photos of ATSER'S management skills using our tax dollars.... (Fred has the contract to manage the sidewalk & asphalt overlay projects throughout the city. ) Let's look at his skills actually put to the test. Fred is SUPPOSE to provide flagmen so traffic isn't a problem for workers, and to also provide workers with a modicum of safety as they work.

ATSER is also to provide INSPECTORS, so we as taxpayers receive materials we are paying for....and so we know when we pay off a contractor, that the job was done, done right, and the job was completed. (kinda hard to get a contractor to COME back after you've paid him off). Anyway....let's look at some of Fred's sidewalk jobs.

Engineer should have moved all objects in path of sidewalk, all cement should have been poured before job was signed off on, and work should not have been passed as is. Not that Herbert Lum would have spoken up about it, this seems to be his forte...but we pay ATSER lots of FEDERAL Dollars (sidewalk projects are CDBG funds Mayor) to MANAGE these jobs. $137 + change to city controller's office for invoices say ATSER charged us for inspectors .... but the results say we didn't get what we paid for Mayor! (federal dollars.....HMMMMMMMM, we're looking into QUI TAM action against ATSER for this.)

Mayor, Housnitch has documented job after job that did not have flagmen, or inspectors on it under Fred Martinez management. We have heard many stories that lead us to believe that more than one asphalt overlay project was/is being delayed because the contractor had to wait on ATSER to get an inspector on the site so the contractor could get a "go ahead" to begin working.

YOU'RE GOING TO RECOMMEND ATSER TO BE THE OWNER'S REPRESENTATIVE FOR THE ARENA???????!!!!!!!!!! RECOMMEND THAT METRO GIVE HIM THE MANAGING CONTRACT FOR THEIR NEW HEADQUARTERS????!!!!!!

WE PROMISE YOU MAYOR, HOUSNITCH IS ASKING FOR A COMPLETE INVESTIGATION INTO ATSER'S WORK SO FAR. BASED ON INVOICES WE HAVE, WE BELIEVE WE HAVE BEEN SCREWED. THE CASE AGAINST HILDA GARZA SCOTT SHOULD HAVE TAUGHT YOU & YOUR MINIONS THAT WE WON'T GIVE UP EXPOSING BAD WORKMANSHIP, BAD "DEALS", OR HAVING OUR MONEY MISMANAGED.

WE ASK YOU TO "RETHINK" ANY RECOMMENDATIONS CONCERNING THIS MAN & HIS COMPANY. THE LAW SAYS WE CAN SUE HIM FOR 3 TIMES WHAT HE HAS RECEIVED IF WE PROVE FRAUD, AND WE INTEND TO DO JUST THAT.

WHEN WE GET A COPY OF THAT HAND DELIVERED LETTER, (AND WE WILL IT IS ONLY A MATTER OF TIME), WE ALSO INTEND TO FILE ETHICS CHARGES AGAINST MR. MARTINEZ.

On DeLibero: A couple of associate degrees in anything is hardly much of a
qualification for CinCMetro.   Even if she had them. She overstated a
pathetic educational background.   I am curious how a position of such
supreme altitude was offered to anyone with two associate degrees.   That
alone is curious.

Whatever DeLibero had in the way of qualifications, education (however
stated) was not the primary reason she was in the running. Most people at
that level have advanced degrees of some sort. Her "real" qualifications had
to be something else.

Either she gives fantastic head, a lot of political clout, some native
management ability, and/or brass.    I don't know the lady, or much about her
real abilities, but she has to have something out of the ordinary to make it
as far as she did.   I don't really know.

She reminds me of Bea Link.   Bold, brassy, articulate and dumb as a post.
I have to admire someone with severe handicaps, such as stupidity, to advance
in this world.

Bottom line: How did she get where she got without any real educational
qualifications?

PS: I don't support Affirmative Action.   It is diametrically opposed to
Equal Opportunity.   The former requires racial discrimination, the latter
prohibits it.

When I got out of the service in 1975, and for the next five years, I was
rejected for job after job hearing the phrase, "But if you were black or a
woman, we'd hire you in a flash. Sorry, but the Federal Govt has told us..."

George Orwell described the language of totalitarianism as "Double Speak", a
language which allowed both extremes of a concept to be included in a word.
The classic example of DoubleSpeak were: "War is Peace, Slavery is Freedom" to which we now add "Equal Opportunity is Affirmative Action".

I was sickened to see the right reverened bill lawson of the wheeler avenue
baptist church use his pulpet to defend delibero. It was even more
sickening to hear his plea that she deserved some sort of special
consideration because she is a black female. Are all black females to be
viewed like the Virgin Mary, not capable of sin? How can we continue to
look the other way when individuals who have been hired or elected to
positions of authority lie and abuse the system they are supposed to
represent? If delibero were a white male, he would have been run out of
town on the next grayhound bus. Delibero lied, plain and simple. She lied
on her resume. She lied in not reporting the accident she was responsible
for in a metro owned vehicle. She holds her employees to a standard of
honesty and integrity which she herself cannot meet! Shame on her. Shame
on bill lawson for condoning her actions. Shame on the mayor for not having
the strength to seek her resignation. Shame on metro's board of directors
for being so spinless and weak and afraid to fire her. Shame on the
citizens of houston for looking the other way and not having the integrity
to demand more of our officials. Shame on us one and all.
