§ 37.12. False Identification as Peace Officer; Misrepresentation of Property

(a) A person commits an offense if:

(1) the person makes, provides to another person, or possesses a card, document, badge, insignia, shoulder emblem, or other item bearing an insignia of a law enforcement agency that identifies a person as a peace officer or a reserve law enforcement officer; and

(2) the person who makes, provides, or possesses the item bearing the insignia knows that the person so identified by the item is not commissioned as a peace officer or reserve law enforcement officer as indicated on the item.

(d) A person commits an offense if the person intentionally or knowingly misrepresents an object as property belonging to a law enforcement agency.

(e) An offense under this section is a Class B misdemeanor.

Housnitch has it on good authority that Ms. Deborah Coleman is already under an OIG/IAD investigation for making a false report, and giving false information against an HPD officer.

LET'S SEE IF WE CAN'T BRING HER TO ACCOUNT FOR THIS ACTION TOO. WE'LL BE FILING ANOTHER COMPLAINT AGAINST HER WITH THE OIG.

(We hear she's threatened to "bury everyone in paper" if she isn't made supervisor at the new HEC center....guess what Deborah....we're gonna give you a taste of your own medicine.)

Seems that a couple of days after filing our complaint, another document showed up on our doorstep. 

Along with the document, were several e-mails to us concerning the OIG's office and some new orders issued by Chief Bradford.

I guess you haven't heard the news that the OIG's office is nothing more than a vindication court for Lee Brown and his cronies.  In fact, it appears that YOU may have trouble filing anything with the OIG.  The rumor going around is that the OIG is now expressly forbidden from investigating ANYTHING without prior approval from Clarence Bradford!  WOW, isn't that reassuring?

Must be that nasty mess surrounding Monique McGilbra is getting too close to the Mayor's Office for Lee P. to be comfortable.  What better way to handle it than to tell his ABC Lackey police chief to shut down the investigation AND the investigators.

Seems like you really didn't know the "known evil" when you flipped
from "Anybody But Brown" to "Nobody But Brown" last year. 
Thank God this man and his circus are only 195 days from history.


We"ll take "unorganized crime" over "organized" crime any day of the week. They are much easier to catch.

Guess what turned up today in the Crime Lab? That missing box of files that IAD et cetera has been looking for for months.

Wonder who put them there??? Maybe Chief Simmons won’t be the only ass to burn!!

Bradford has issued orders that NO investigations are to be conducted without HIS approval. All of the surveillance equipment has been taken away from the OIG, and in direct VIOLATION to EXECUTIVE ORDER 1-39 The OIG is to report to the Chief's legal staff and not the City Attorney, or DA. Inspectors are now gone, and even if an OIG Sergeants sees a city employee committing a crime, without his/her surveillance equipment, it's a no-go.  NO ONE IS TO BE PRO-ACTIVE.

All in-take Sergeants are to take the complaint, and pass it on to the Chief's legal people for the Chief's approval before any investigation is done. Also no more investigations are to be done on anonymous tips. In establishing this office the Mayor allowed for this, in order to keep city workers from being retaliated against.

I believe you'll find the letter confirming that the OIG's office is no longer to be PRO-ACTIVE very soon on your doorstep.

Those missing DNA lab audit files? You know the ones that mysteriously "reappeared". Word here amongst HPD is that someone needs to call in the Texas Rangers. Some files are believed still "missing" while other's have been altered/replaced. (Someone should dust them for prints, but NOT any one with HPD.)

HERE'S THAT EXECUTIVE ORDER GUYS:

No. 1-39: Establishment of Office of Inspector General for Investigation of Employee Misconduct
(Effective Date 2.03.98)

1. PURPOSE

The purpose of this Executive Order is to establish the office of the City of Houston Inspector General. This office will be formally designated the "Office of the Inspector General" (hereinafter, the "OIG"), a division of the Office of the Mayor.

2. OBJECTIVES

The objective of this Executive Order is to establish a central authority to investigate allegations of employee misconduct, both criminal and administrative, concerning City employees. The mission of the OIG is:

a. To conduct, supervise, monitor and initiate investigations relating to misconduct with respect to all City employees, including, but not limited to, investigations of classified employees pursuant to Chapter 143, Local Government Code;

b. To provide leadership and coordination and to recommend policies designed to promote fairness, uniformity, efficiency and effectiveness in the conduct of employee-related investigations; and

c. To provide a central resource for keeping the Mayor fully and currently informed concerning the scope of employee misconduct and to assure the most timely and efficient investigation service possible.

3. ORGANIZATION OF OIG

Appointment

The Mayor shall designate an Assistant Chief of Police to act with the title and authority of the Inspector General of the City of Houston.

4. DUTIES OF OIG

The duties of the OIG are:

a. To investigate and report alleged criminal and administrative misconduct by a City employees;

b. To recommend procedures and policies to the Mayor regarding improvements in the area of employee conduct;

c. To coordinate and supervise City personnel and resources presently devoted to the investigation of employee misconduct;

d. To train City employees within the OIG in specialized investigative techniques with respect to employee misconduct;

e. To provide information to the City Ethics Committee, the City Civil Service Commission, City department heads, the City Council Ethics Committee, and the Office of the City Attorney as appropriate to facilitate the successful and efficient investigation of employee misconduct cases;

f. To coordinate the collection of information and to serve as a repository for information on misconduct by City employees; and

g. To report to the Mayor on a regular basis the types and numbers of misconduct cases involving City employees.

5. TABLE OF ORGANIZATION

The OIG shall be composed of three divisions:

a. The Internal Affairs Division of the Houston Police Department;

b. The Internal Affairs Division of the Houston Fire Department; and

c. The Public Integrity Review Group.

6. EXISTING CITY INVESTIGATIVE RESOURCES

City employees currently assigned to the Loss Prevention/Security Division -- Department of Public Works and Engineering and the Affirmative Action and Contract Compliance Division of the Mayor's Office who investigate employee misconduct are hereby reassigned to the Public Integrity Review Group Division of the OIG. All employees assigned to the Public Integrity Review Group of the Houston Police Department are also reassigned to the Public Integrity Review Group Division of the OIG. Employees assigned to the Internal Affairs Divisions of the Houston Fire and Police Departments will operate under the aegis of the OIG. The Internal Affairs Division of the Houston Police Department shall continue to report to the Chief of Police.

7. RULES AND PROCEDURES

The OIG shall have the authority to promulgate written rules and/or procedures necessary to implement the goals of this Executive Order, subject to the review and approval of the Mayor, Chief of Police and the City Attorney.

8. ROLE OF THE CITY ATTORNEY

The City Attorney or his or her designee shall be consulted by the Inspector General prior to the initiation of any investigation and will be consulted throughout the investigation, as necessary, for the purpose of addressing legal and procedural matters. The City Attorney is charged with the responsibility of protecting the privileged status of all documents generated by the OIG, to the extent legally possible and will coordinate any release of documents generated or maintained by the OIG.

9. ROLE OF THE CITY CONTROLLER

The City Controller will be consulted by the Inspector General in those instances where the alleged employee misconduct involves matters of impropriety in City contracting or fiscal management. The City Controller has agreed to provide and will provide auditing and financial expertise to the Inspector General as needed for investigations of such matters.

10. DUTIES OF DEPARTMENT HEADS

All City Department Heads are charged with responsibility to cooperate with any investigation conducted by the OIG.

11. DUTIES OF CITY EMPLOYEES

All City employees shall have an affirmative duty to report to the OIG, in writing, any incident of criminal or administrative misconduct by any employee of the City of Houston. This provision shall not abrogate the duty of any City employee to comply fully with all existing state laws, City ordinances, City departmental policies or other City policies regarding reporting of employee misconduct, but shall be in addition to any such duties.

12. REPORTING

The OIG shall report, on a regular basis, as may be prescribed by the Mayor, summaries of the types and numbers of employee misconduct cases investigated. Such reports shall be general in nature and shall be subject to review by the Office of the City Attorney for the purpose of addressing legal and procedural matters. The reports shall not contain any particularized details that might compromise investigations or pending disciplinary or judicial actions.

13. LIMITS OF AUTHORITY

a. The OIG is solely an investigative and reporting agency. The OIG shall not recommend or engage in disciplinary action, except insofar as the OIG may provide information to, and cooperation with, an appropriate enforcement or disciplinary agency.

b. The OIG shall have authority to allocate staff and conduct investigations consistent with this Executive Order, provided that any applicable provisions of state law or City ordinance specifying investigative procedures in certain circumstances shall be observed.

14. INCONSISTENT POLICIES

This Executive Order supersedes any and all prior policies and/or executive orders to the extent such policies or executive orders are inconsistent with this Executive Order.

NOW, SINCE BRADFORD IS TO OK ALL INVESTIGATIONS----WHO DO WE GET TO INVESTIGATE BRADFORD??? IF BROWN IS SMART (AND WE HAVEN'T SEEN THAT HE IS) HE'LL DEMAND THAT THE TEXAS RANGERS STEP IN AS SUGGESTED BY OUR WRITER, AND VERY QUICKLY DISTANCE HIMSELF FROM THE CHIEF.


We saw an article in the Chronicle about several Mayoral candidates not wanting lobbyists working political campaigns.

Seems one of the City's most highly paid lobbyist, and Mayoral consultant Dave Walden, who was lobbying hot and heavy for that Voice Over IP, has been operating/lobbying without paying his lobbying fee to the City.

But, let's be fair about them representing Sanchez this time around...word on the street has it they were told by the RNC that if they didn't represent him, after 6 yrs of representing Brown (a democrat) , then they could no longer call themselves republicans.

Wonder if we could rescind that contract because Dave wasn't legally registered to represent them? (nice dreams)

Phil B. Scheps, Director of Finance & Administration for the City, very recently commented in a luncheon with the Houston Property Rights Association, that the layoffs in Building Services were not from the lower levels, but from project managers.

REALLY??????? Then can you tell me why maintenance staff at HPD Central Command station has fallen from 32 to only 8.

Are you telling Housnitch that 24 people located there were all project managers?
